Nuovo ristorante “Casa mia” – New restaurant “Casa mia”

La liberalizzazione di molti servizi che tradizionalmente vengono offerti solo da professionisti sta facendo crescere una nuova economia parallela. Air B&B nel settore delle strutture ricettive, Bla Bla Car e Uber nel settore dei trasporti e ora l’attività di Home restaurant, sono sicuramente un segno dei tempi e figli di quel grande motore di innovazione che sa essere internet. Ovviamente il cambiamento è sempre portatore anche di discussioni e polemiche a cui lo stato deve cercare di dare risposte con interventi normativi appropriati. E’  proprio ciò che è successo recentemente con la ristorazione casalinga. Ma dell’Home Restaurant cosa ne pensa la Crusca?

The liberalization of many services traditionally offered only by professionals is driving a new parallel economy. Air B&B in the hospitality sector, Bla Bla Car and Uber in the transport sector and now the Home restaurant business are certainly a sign of the times and children of that great innovation engine that knows how to be the internet. Obviously, change is also always the bearer of discussions and controversies to which the state must try to give answers with appropriate regulatory interventions. This is exactly what has happened recently with home catering. But what does Crusca think about the Home Restaurant?

Home Restaurant: ovvero la possibilità di sentirsi emuli di Cracco, Canavacciuolo o Chef Rubio davanti ai fornelli di casa propria, offrendo al contempo la propria cucina come ristorante occasionale per amici, conoscenti e perfetti sconosciuti (viaggiatori soprattutto). La cucina rustica e indigena direttamente dalle mani di chi magari la prepara ogni giorno per sé o per la propria famiglia (magari proprio la mitica nonna!).

L’attività è stata recentemente definita dall’approvazione, per il momento data dalla Camera di un disegno di legge specifico. CI vorrà ancora tempo perchè anche il Senato dia il via libera ma intanto le linee direttrici ci sono. La regolamentazione ruota intorno a tre figure: il gestore, l’operatore cuoco e l’utente fruitore.

La prima è il gestore ovvero “il soggetto che gestisce la piattaforma digitale finalizzata all’organizzazione di eventi enogastronomici”. Diverse sono i siti web dove si può accedere a questo servizio, uno tra i più famosi è certamente Gnammo totalmente made in italy come New Gusto, ma fanno parte del panorama anche Ploonge e People Cooks.

Le proposte vanno da pranzi e cene Home Food per assaporare la cucina genuina di casa, a proposte di cucina vegana, fino a veri e propri eventi speciali come la cena all’interno di un furgone Wolkswagen o sotto le stelle, per finire con cene abbinate a corsi di cucina e showcooking.

In genere permettono anche, tramite dei motori di ricerca interni, di individuare i profili dei nostri ospiti ideali in base al titolo professionale, alle competenze e alla localizzazione geografica.

Inutile dire che la possibilità di connessione e di gestione di dati offerta da internet offre spunti e abbinamenti interessanti.

Gnammo permettedi riunire la passione per la cucina a quella per le cause sociali con periodi in cui donare parte del ricavato in beneficenza.

E se i soldi sono il vostro problema? Allora ecco che corre in vostro aiuto People Cooks grazie al quale potete gustare cucina casalinga low cost, un pasto infatti non può costare più di 6 euro.

Il gestore ovviamente ha precise responsabilità rispetto alle altre figure:

  • deve tracciare e registrare tutte le informazioni importanti dgli eventi
  • deve gestire i dati nel rispetto delle normative pertinenti come la privacy
  • deve registrare e conservare lo storico degli eventi anche di quelli annullati o di mancata realizzazione

Una delle credenziali volute dalla legge è una polizza assicurativa che deve avere il cuoco, una responsabilità civile per i danni che è possibile causare a terzi con la propria opera. Una sorta di assicurazione professionale se volete, di certo un onere ma anche una importante tutela nei confronti dei fruitori.

Le informazioni dovranno essere tenute a disposizione per gli organi di controllo che dovranno infatti essere informati degli appartamenti registrati per questo tipo di servizi.

The activity was recently defined by the approval, for the moment given by the House, of a specific bill. It will still take time for the Senate to give the green light but in the meantime the guidelines are there. The regulation revolves around three figures: the manager, the cook operator and the user user.
The first is the manager or “the person who manages the digital platform aimed at organizing food and wine events”. There are several websites where you can access this service, one of the most famous is certainly Gnammo totally made in Italy like New Gusto, but Ploonge and People Cooks are also part of the panorama.
The proposals range from Home Food lunches and dinners to savor genuine home cooking, to vegan cuisine, to real special events such as dinner in a Wolkswagen van or under the stars, ending with matching dinners. to cooking classes and showcooking.
They also generally allow, through internal search engines, to identify the profiles of our ideal guests based on their professional title, skills and geographical location.
It goes without saying that the possibility of connection and data management offered by the internet offers interesting ideas and combinations.
Gnammo allows you to combine the passion for cooking with that for social causes with periods in which to donate part of the proceeds to charity.
What if money is your problem? So here comes People Cooks to your aid thanks to which you can enjoy low cost home cooking, a meal in fact cannot cost more than 6 euros.

The manager obviously has specific responsibilities with respect to the other figures:
must track and record all important event information
must manage data in compliance with relevant regulations such as privacy
must record and keep the history of events including those canceled or non-realization
check the credentials required by the “cook operator”
provides the user with transparent information
One of the credentials required by the law is an insurance policy that the cook must have, civil liability for any damage that can be caused to third parties with one’s work. A sort of professional insurance if you want, certainly a burden but also an important protection towards users.
The information must be kept available for the control bodies who must in fact be informed of the apartments registered for this type of service.

Non tutto è home restaurant però. Se l’utente operatore cuoco organizza un numero di eventi enogastronomici in un anno solare inferiore a cinque e a cinquanta pasti totali e se l’unità abitativa in cui si svolge l’evento viene utilizzata nel corso di un anno solare per un numero di volte inferiore a cinque, l’attività è di social eating e non sono richiesti requisiti particolari.

Alcuni dei limiti che definiscono l’attività vanno un po’ stretti al popolo del social eating. Un home restaurant non può superare il limite di cinquecento coperti per anno solare. Tale limite è considerato per unità immobiliare utilizzata o per operatore cuoco, cioè la seconda figura definita dalla legge.

Ovviamente la legge chiede assicurazioni anche sugli immobili in cui gli eventi vengono organizzati che devono avere le appropriate caratteristiche igieniche e di abitabilità e non devono essere immobili in locazione per periodi inferiori ai 30 giorni. La cosa più rilevante è tuttavia che non devono essere unità abitative usate per attività ricettivo-turistiche in forma non imprenditoriale. Non è quindi possibile creare un ibrido Air B&B / Social eating per offrire il meglio dei due mondi, anche questo punto ha deluso molti dei sostenitori dell’home restaurant.

Ma quali sono i doveri e le responsabilità della terza figura, l’utente usufruitore? Beh sostanzialmente nessuna, si tratta di comportarsi bene, registrarsi e gradire i pasti, semplice no?

Not everything is home restaurant though. If the cook operator organizes a number of food and wine events in a calendar year of less than five and fifty total meals and if the housing unit in which the event takes place is used in the course of a calendar year for a number of times less at five, the activity is social eating and no special requirements are required.
Some of the limits that define the activity are a little tight for the people of social eating. A home restaurant cannot exceed the limit of five hundred covers per calendar year. This limit is considered for the real estate unit used or for the chef operator, that is the second figure defined by the law.
Obviously, the law also requires insurance on properties where events are organized, which must have the appropriate hygienic and habitable characteristics and must not be rented properties for periods of less than 30 days. The most important thing, however, is that they must not be housing units used for hospitality-tourism activities in a non-entrepreneurial form. It is therefore not possible to create an Air B&B / Social eating hybrid to offer the best of both worlds, even this point has disappointed many of the supporters of the home restaurant.
But what are the duties and responsibilities of the third figure, the user user? Well basically none, it’s about behaving well, signing up and enjoying meals, simple isn’t it?

Ultimo ma di certo non per importanza un requisito richiesto a qualsiasi attività che si occupa di ristorazione e somministrazione: il rispetto delle buone pratiche di lavorazione e dell’igiene. 

L’argomento non è di quelli da poco in realtà e meriterà una riflessione più approfondita quando uscirà il decreto del Ministero della Salute che dovrà dettare le regole a cui gli operatori cuochi dovranno attenersi e, presumibilmente, i gestori verificare.

Una cucina di casa presenta problematiche di sanificazione maggiori rispetto ad un’attività alimentare per la struttura e concezione che preferisce design a funzionalità, per i materiali che non possono spesso competere con la garanzia che offre l’acciaio inox, con le attrezzature che per quanto buone non sono pensate per un uso “professionale”. 

Non aiuta poi a mio parere anche la dimensione raccolta e più informale dell’attività, che favorisce la sottovalutazione dei pericoli

e il minor rigore nell’applicare regole, procedure, prassi che anche nella ristorazione commerciale faticano ancora ad essere applicate in pieno e con convinzione. Non si tratta certo di problemi insuperabili, ma di questioni che saranno al centro del dibattito futuro su questo nuovo tipo di attività alimentare, destando probabilmente polemiche e discussioni infinite.

Una controversia di sicuro rimarrà nell’aria anche dopo che l’azione normativa avrà consolidato questa nuova attività: quella sul nome da darle. Secondo la prestigiosa Accademia della Crusca infatti l’idea di definire nella legge con un termine inglese una delle attività per le quali l’Italia è maggiormente famosa, sarebbe un po’ uno scivolone. Il legislatore avrebbe dovuto magari sforzarsi un po’ di più, certo che il termine alternativo suggerito, “ristorante domestico”, risulta però mai come in questo caso un po’ insipido!

Last but certainly not least a requirement required of any business that deals with catering and administration: compliance with good processing and hygiene practices.
The argument is not a trivial matter in reality and will deserve a more in-depth reflection when the decree of the Ministry of Health comes out, which will have to dictate the rules to which the chefs will have to comply and, presumably, the managers to verify.
A home kitchen presents greater sanitation problems than a food business due to the structure and conception that prefers design to functionality, for the materials that cannot often compete with the guarantee offered by stainless steel, with the equipment that however much good are not intended for “professional” use.
In my opinion, the intimate and more informal dimension of the activity, which favors the underestimation of the dangers, does not help
and less rigor in applying rules, procedures, practices that even in commercial catering are still struggling to be applied fully and with conviction. These are certainly not insurmountable problems, but issues that will be at the center of the future debate on this new type of food business, probably arousing endless controversies and discussions.
A controversy will certainly remain in the air even after the regulatory action has consolidated this new activity: that on the name to give it. In fact, according to the prestigious Accademia della Crusca, the idea of ​​defining one of the activities for which Italy is most famous in the law with an English term would be a bit of a slip. The legislator might have had to try a little more, certain that the alternative term suggested, “domestic restaurant”, is nevertheless never a bit bland as in this case!
